The following Rules and Regulations form an agreement between Lotto.li and YOU. Please read them carefully! You do not have to sign this agreement but by entering the Draw(s) you signal your full acceptance and understanding of these Rules and Regulations.
Definitions
- Charities - The beneficiaries of any money paid by the Foundation to a not-for-profit organization having a charitable purpose, as determined by the Charity Allocation Committee of the Foundation, in its sole discretion.
- Deposit Account - Account holding authorized or cleared payments and associated transactions. No Withdrawals may be made against this account.
- Dormant Account - Account which shows no activity for a period of twelve (12) consecutive months.
- Draw - The random selection of winning combinations for any particular game.
- Foundation - International Lottery in Liechtenstein Foundation, which is supervised by the Liechtenstein Government.
- Marketing Fee - The fee charged to the Player by partners of ILLF for the marketing and promotion of the games.
- Parties - Lotto.li and a Player.
- Player - A person who pays to enter a Draw or play a game.
- Prize - Money won by a Player.
- Prize Pool - Amount available for prizes.
- Purchase Price - The amount paid by a Player for entry into a game, inclusive of a marketing fee.
- Stake - For a single Player means the payment made for a Ticket by a Player and "Stakes" means the payments made by all Players in respect of a particular Draw (both Stake and Stakes exclude any marketing fees or license fees paid by the Player).
- Ticket Price - The cost of a ticket for entry into a game, exclusive of a marketing fee.
- Winner - Player who wins a Prize.
- Winnings Account - Account holding payments in respect of Prizes against which Withdrawals may be made.
Legal Position
It is legal to play at Lotto.li.
The Lotto.li lotteries are authorised and controlled by the government of Liechtenstein, a small sovereign state in the heart of Europe that is a member of the United Nations and of the European Economic Area. All the servers are located in Liechtenstein and the lotteries are sold through the Internet from these servers.
Our opinion is that you are not breaking any laws while playing at Lotto.li.
Ineligible Parties
People under the age of 18 years may not open a Lotto.li account, nor may they enter a Draw or play any of the games. Players who win Prizes will be required to show that they were over the age of 18 years at the time that they entered.
Lotto.li is unable to accept entries through Swiss servers.
Employees, servants, agents and family of Lotto.li and all associated companies and representatives, partners and staff of Thöny Treuhand AG, are ineligible to take part. (Note: "family" for the purpose of this clause is defined as "minor children and spouse")
The legal advisers of Lotto.li are of the opinion that, when playing Lotto.li through the Internet, Players are travelling to Liechtenstein where the transaction takes place. Individuals should satisfy themselves as to their particular status before they enter.
Entry
Contracts between Lotto.li and Players are not completed until their entries are received in the Lotto.li offices in Liechtentstein and the credit card transactions are authorized, or the required amount is deducted from the Player's Lotto.li Deposit Account or Winnings Account.
Lotto.li will not pay the Prize or Prizes to which a Player might otherwise be entitled if their payment is dishonored in any way and for whatever reason. Lotto.li further reserves the right to cancel all outstanding entries for such players and to prevent them from playing again.
Lotto.li reserves the right to refuse entries.
In the event that there is a discrepancy between the numbers that a Player believes that they have entered, or the graphic display of the game they have played, and those in the database maintained by Lotto.li, the numbers in the database are considered valid. The responsibility for checking the details of any entry for a Draw rests with the Player at the time that the entry is made into the database in Liechtenstein.
Lotto.li will not accept responsibility for any delay in receipt of an entry for a Draw.
A minimum deposit of EUR15 and a maximum deposit of EUR500 per week may be made using a single credit card.
Entries may not be cancelled after they have been confirmed by Lotto.li.
Lotto.li reserves the right to prevent entry into a specific game, or specific numbers within a given game, at any time.
The status of your entries may be confirmed by selecting the 'My Tickets' link and choosing the relevant Draw from the drop down lists. Last entries for this Draw will be taken at 14.55 Central European Time (CET), one hour before the beginning of the Draw sequence. Entries after 14.55 (CET) will be entered for the following Draw.
Prize Claims
Lotto.li players are never required to submit any kind of claims fee or cash sum to receive their winnings. In the event that Players are asked for any such fee, particularly if they are unaware of actually entering the game, it is likely they are being targeted by an 'Advance Fee Fraud' hoax and are advised not to make any such payments whatsoever.
Prizes are automatically credited to the Player's Winnings Account and are reflected in the winnings balance. Players may request payment of the winning balance at any stage. Amounts under EUR100 will be paid in cash. Players withdrawing winnings of more than EUR100 will be paid by cheque or bank transfer, depending on your country of residence. Cheques are sent by mail and are received in approximately 15 days. Prizes over EUR10,000 are subject to a 30 day delay. Winners may Withdraw their winnings by submitting their personal details through the Withdrawal screen.
Winners will be asked to show evidence that they are eligible to take part (see Ineligible Parties) and that they are authorized to use the credit card which paid for the winning ticket.
Lotto.li will make reasonable endeavors to contact Winners via e-mail, but Winners are responsible for checking whether they have won.
Dormant accounts which have an account balance will be levied a yearly administrative fee of EUR 10.00 commencing from the date the account becomes dormant. If an account balance is under EUR 10.00, only the amount in the account will be deducted. When an account reaches zero balance, no further fees will be applied. If after a period of two years, the account remains dormant and has a balance and the Player has not contacted the Foundation and provided any contrary instructions, any funds remaining in the Dormant Account shall be remitted to ILLF, and the Player shall forfeit any right to any funds in such Dormant Account. Free tickets which have not been used for a period of 2 years will expire on 31 August 2010.
Players' funds are held by Liechtensteinische Landesbank AG, a AAA rated bank and whose majority ownership is held by the Principality of Liechtenstein.
Lotto prize money allocation
66.7% of the purchase price for a Draw in the Lotto.li game is payable on account of the Ticket price, with the remaining 33.3% paid as a Fee to third party marketing partners engaged by the Foundation. Of the portion paid for the Ticket price, 90% of these monies are contributed to the Prize Pool. The distribution of the portion of the Ticket allocated to the Prize Pool is as follows:
- 2% of the Prize Pool is used to fund winners for a 6 number match plus Bonus Ball
- 8% of the Prize Pool is used to fund winners for a 6 number match
- 10% of the Prize Pool is used to fund winners for promotional incentive prizes
- on average 2% of the Prize Pool is used to fund winners for a 5 number match plus bonus ball
- on average 4% of the Prize Pool is used to fund winners for a 5 number match
- on average 7% of the Prize Pool is used to fund winners for a 4 number match
- on average 30% of the Prize Pool is used to fund winners for a 3 number match
- on average 37% of the Prize Pool is used to fund winners for a 2 number match
5+ bonus and 5 ball prizes are calculated as a pro-rata share of the remainder of the prize pool after the 6+MB, 6, promotional, 4, 3 and 2 ball prizes have been paid. In the unlikely event that 2 ball prizes exceed 83% of the Stakes placed, Lotto.li will pay exactly 37% of total stakes split amongst 2-ball winners instead of a EUR 5 prize. In the unlikely event that 3 ball prizes exceed 66% of the Stakes placed, Lotto.li will pay 30% of total stakes split amongst 3-ball winners instead of a EUR 30 prize. In the unlikely event that 4 ball prizes exceed 15% of the Stakes placed, Lotto.li will pay 7% of total stakes split amongst 4-ball winners instead of a EUR 120 prize. If a single stake could win more than one individual Prize in a Draw, only the single highest individual Prize will be paid for all prize categories.
The following prizes are insured through a Lloyd's broker:
6 + Bonus number match minimum is EUR20,000,000.00 (paid as an annuity).
The actual prize above this minimum amount is dependent on ticket sales and insurance costs.
Players may opt to receive a lump sum instead of an annuity with regard to the above prize. The lump sum for a 6 + Bonus number match is a minimum of EUR10,000,000.00. The actual prize above this minimum amount is dependent on ticket sales and insurance costs. EUR180,000.00 will be deducted from the above prize for insurance costs. This sum will not be requested from the player, it will be deducted from the prize given to them.
6 number match EUR2,000,000.00 (paid as an annuity)
Players may opt to receive a lump sum instead of an annuity with regard to the above prize. The lump sum for a 6 number match is EUR1,000,000.00.
In the event of more than one entry winning an insured prize, only the lump sum payment will be made, split equally amongst the winning entries.
Entries into Lotto have a mathematical possibility of winning the 6 number plus Bonus Ball match prize of 1 (one) in 601,304,088. Entries have a mathematical possibility of winning the 6 number match insured prize of 1 (one) in 14,316,764
Limits of Liability
The decision of Lotto.li will be final and binding in all matters and no correspondence will be entered into.
International lottery laws vary and it is the responsibility of Players to ensure that they understand and comply fully with any laws or regulations relevant to themselves in their own country, particularly where tax and age restrictions apply. All Players must be at least 18 years old. Lotto.li does not accept responsibility for any third party claims against Players.
Players are responsible for Withdrawing or playing off any funds which are held in the Winnings Account. Lotto.li does not undertake to make players aware that they have outstanding Winnings to collect.
Lotto.li's liability in respect of any claim or loss will be limited to the stake paid by the Player.
Lotto.li has the right to suspend or withdraw any Draw at its absolute discretion.
Any entry for a Draw that contains fewer than the required minimum number of numbers will be deemed to be invalid.
In the event of more than one Player matching the required winning numbers, the Prize will be shared equally.
Personal details of all Players will remain confidential unless Players consent to their details being used for future publicity purposes.
Lotto.li will not be liable for any loss of whatever nature arising from the cancellation of any Draws, including the loss, for whatever reason, of the chance to participate in a Draw.
In particular, but without prejudice to the generality of the foregoing, Lotto.li will not be liable to any person:
in the event of force majeure,
for the failure of, or damage or destruction to Lotto.li's central computer system or records, or any part thereof,
for delays, losses, errors or omissions resulting from failure of any telecommunications or other data transmission system,
for any delay resulting in non receipt of any entry for a particular Draw.
Lotto.li will not be liable for any loss as a result of an act of God, an outbreak of hostilities, riot, civil disturbance, acts of terrorism, the act of any government or authority (including refusal or revocation of any licence or consent), fire, explosion, flood, theft, malicious damage, strike, lock-out, or industrial action of any kind.
The Parties shall not commit nor purport to commit the other to honor any obligation other than is specifically provided for by these Rules and Regulations.
Lotto.li does not accept liability for damages which may be caused by the interception or misuse of Player's credit card details on the Internet, unless stated to the contrary on Lotto.li's pages.
These Rules and Regulations constitute the entire agreement and understanding between the Parties. If there is a discrepancy between the English language version of these rules and any other language version the English language version is correct.
Disputes
If there is a dispute regarding an entry or eligibility for a Prize or claim, the decision of Lotto.li will be final and binding.
The relationship between the Parties as well as this agreement is governed by and construed in accordance with the laws of the Principality of Liechtenstein whose courts shall be the courts of jurisdiction.
Lotto.li reserves the right to amend these Rules and Regulations from time to time and vary any of them without prior notice.
